SECTION I) INFORMATION NOTICE AND PRIVACY POLICY REGARDING THE PERSONAL DATA PROTECTION LAW NO. 6698

1)Data Controller
1.1) In accordance with the Personal Data Protection Law No. 6698 (KVKK), your personal data may be processed by MİRZA TARIM (Site Owner/Company), located at Pınarlı Mah. Atatürk Bulvarı No: 175 Aksu/ANTALYA, which is the data controller within MİRZA TARIM, within the scope described below.
1.2) In this Privacy Policy and KVKK Disclosure Text, conditions and terms regarding the use of personal data shared by Site/Mobile application users/members/visitors (“Data Subject”) with the company or arising during the Data Subject’s use of the Site during the operation of the www.mirzatarim.com website and platform operated by MİRZA TARIM and its Mobile application are set forth.
2) For What Purpose Are Personal Data Processed?
2.1) Your collected personal data may be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK for the purposes of ensuring the legal and commercial security of MİRZA TARIM and persons in a business relationship with MİRZA TARIM, and determining and implementing commercial and business strategies. Your collected personal data may be transferred to our business partners, shareholders, legally authorized public institutions, and private individuals within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.
2.2) Your personal data will not be used for any purposes other than those specified above and will not be shared with or transferred to third parties, except for legal obligations and official institutions/organizations. Your personal data may only be processed and transferred within the scope of the personal data processing conditions and purposes specified in the Personal Data Protection Law No. 6698, which entered into force upon its publication in the Official Gazette dated April 7, 2016, and numbered 29677.
3) What is Personal Data?
3.1) The personal data processed by MİRZA TARIM is described below in accordance with the principles set forth in the Personal Data Protection Law. The term “personal data” includes, but is not limited to, the following information: Identity and Contact Information: name, surname, telephone number, address, workplace information, email address. Your current location information will be retained for the shortest period necessary in accordance with the relevant law.
3.2) Data anonymized in accordance with Articles 3 and 7 of the Law shall not be considered personal data under the provisions of the said law, and processing activities related to such data shall be carried out without being subject to the provisions of this Privacy Policy. 4) What is the Purpose of Using Your Data?
4.1) The personal data you share with the Site Owner, MİRZA TARIM, is used for the following purposes: to enable you to benefit from the services provided by the Site Owner and through the Site or Mobile Application; to complete your membership registration on the Site; to make updates related to your membership registration; to improve the services offered by the Site Owner and through the Site, to introduce new services, and to provide you with the necessary information in this regard; to conduct commercial activities; determining and implementing commercial and business strategies, ensuring the legal and commercial security of the Site Owner and persons in a business relationship with the Site Owner, providing you with the necessary information in this regard, and fulfilling the obligations arising from the nature of these activities.
4.2) The personal information in question is primarily collected for the purpose of contacting you. Your data is processed for customer satisfaction-based purposes such as improving your experience on the mobile application, evaluating the communication management process, and conducting satisfaction surveys. This processed data may also be used for internal reporting and business development activities. Additionally, it may be used to perform various statistical evaluations, create databases, and conduct market research in an anonymous manner without disclosing your identity.
4.3) Pursuant to Articles 5 and 8 of the Law and/or in the event of exceptions in the relevant legislation, the Site Owner may process personal data and share it with third parties without the additional consent of the Data Subjects. The most fundamental of these situations are listed below: Where expressly provided for by law; Where it is necessary to protect the life or physical integrity of the person who is unable to express their consent due to actual impossibility or whose consent is not legally valid, or of another person; Where it is necessary for the establishment or performance of a contract between the Data Subject and the Site Owner, provided that it is directly related to the establishment or performance of such a contract; the processing of personal data is necessary for the Site Owner to fulfill its legal obligations, the Data Subject has made the data public, the processing of data is necessary for the establishment, exercise, or protection of a right, the processing of data is necessary for the legitimate interests of the Site Owner, provided that it does not harm the fundamental rights and freedoms of the Data Subject.
4.4) For data collection purposes, the Site Owner may use cookies and, within this scope, process data and transmit it to third parties solely to the extent required by the analysis services provided by such third parties for the purpose of processing such data. (See: SECTION III Cookie Policy)
5) To Whom and for What Purpose May the Processed Data Be Transferred?
5.1) Your collected personal data may be shared with third parties such as third-party service providers, (including SMS and email service providers), hosting services, law firms, and other third parties. To enable our business units to carry out the necessary work to provide you with the products and services offered by our company and its affiliates, to customize the products and services offered by our company and its affiliates according to your preferences, usage habits, and needs and to recommend them to you, to ensure the legal and commercial security of persons in a business relationship with our company and its affiliates, to provide administrative operations related to communication conducted by our company, Ensuring the physical security and control of Company locations, partner/customer/supplier (authorized or employees) evaluation processes, reputation research processes, legal compliance process, auditing, financial affairs, etc.) Determining and implementing our Company’s commercial and business strategies and ensuring the execution of our Company’s human resources policies for our business partners, Group Companies, CompanyTo enable our company and its affiliated companies to provide you with the products and services they offer, the necessary work is carried out by our business units. The products and services offered by our company and its affiliated companies are customized according to your preferences, usage habits, and needs and recommended to you. ensuring the legal and commercial security of individuals who have a business relationship with our company and our affiliated companies, ensuring administrative operations related to communication carried out by our company, ensuring the physical security and control of locations belonging to the Company, partner/customer/supplier (authorized or employees) evaluation processes, reputation research processes, legal compliance process, audit, financial affairs, etc.) For the purposes of determining and implementing our company’s commercial and business strategies and ensuring the execution of our company’s human resources policies, personal data may be transferred to our business partners, Group Companies, company officials, shareholders, legally authorized public institutions, and private individuals within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Personal Data Protection Law.

5.3.) As the Data Subject, you warrant that the information covered by this Privacy Policy is complete, accurate, and up-to-date, and that you will promptly update such information in the event of any changes. The Site Owner shall not be liable if you fail to provide up-to-date information.
5.4) As the Data Subject, you acknowledge that if you make a request that would result in the Site Owner being unable to use any of your personal data, you may not be able to fully benefit from the operation of the Site or Mobile Application, and you declare that you will be solely responsible for any liability arising in this regard.
6) How Long Are Your Data Stored? The personal data you have shared with the Site Owner will be stored for the period required for the purposes specified in this Privacy Policy and for the limitation periods specified in the relevant legislation. Furthermore, your personal data may be stored for a limited period of time in order to enable the necessary defenses to be made in the event of any dispute that may arise between you and the Site Owner.
7) How Do We Ensure the Security of Your Data?
7.1) The Site Owner shall take the necessary technical and administrative measures, considering the costs, to ensure the minimum level of security in order to prevent the unlawful processing of personal data, unlawful access to personal data, and to ensure the protection of personal data, in accordance with the conditions specified in the relevant legislation or stated in this document. Despite the Site Owner taking the necessary information security measures, the Site Owner shall not be liable in the event that confidential information is damaged or falls into the hands of third parties as a result of attacks on the Site and the system.
7.2.) The Site Owner also does not disclose the personal data obtained from you to others in violation of this Privacy Policy and the provisions of the Personal Data Protection Law, nor does it use such data for purposes other than processing.
7.3) If links to other applications are provided on the Site, the Site Owner assumes no responsibility for the privacy policies and content of such applications and recommends that you review these policies.
8) Changes to the Privacy Policy This Privacy Policy may be updated from time to time to comply with changing conditions and legislation.
